Branding Optics

Refund and Cancellation Policy

Effective date: September 20, 2026

This Refund and Cancellation Policy applies to purchases from Industry Marketing Group, LLC dba Branding Optics ("Branding Optics," "we," "us," or "our"). It is incorporated into our Terms and Conditions.

1 Fourteen Day Free Trial

Eligible new customers may receive a 14-day free trial as shown at signup. If payment information is required and the trial is configured to convert automatically, the price, billing frequency, and first charge date will be disclosed during enrollment. Cancel before the disclosed conversion time to avoid the first paid charge. Trial eligibility, features, credits, and limits may be restricted, and we may end a trial for abuse or violation of our Terms.

2 Subscription Charges

Subscription fees are nonrefundable once charged, including when an account is unused or only partially used during a billing period. Subscriptions generally renew monthly until automatic renewal is disabled or the subscription is canceled.

You may cancel or disable automatic renewal at any time through available account controls or by contacting us. Cancellation takes effect at the end of the current paid term. You may continue using the applicable plan until then, and no additional recurring subscription charge will be made after cancellation takes effect. Cancellation does not refund the current term or cancel charges already incurred.

3 Messaging Credits and Credit Packs

One-time credit-pack purchases and automatic top-off purchases may be eligible for a refund if the purchased credits have not been used, depleted, transferred, expired, or associated with suspected fraud or abuse. Submit a request promptly after purchase and identify the transaction.

If only part of the purchased credit pack remains unused, we may, in our discretion and where technically feasible, issue a prorated refund for the unused portion. The prorated amount may exclude credits already consumed, promotional or bonus credits, nonrefundable carrier or registration charges, taxes we cannot recover, payment-processing costs where permitted, and other third-party costs already incurred.

Credits consumed by submitted, processed, filtered, failed, undelivered, or carrier-rejected messages may still be treated as used when Branding Optics or a provider incurred the related cost. Disabling auto top-off prevents future top-offs but does not reverse a transaction already initiated.

4 Usage Carrier and Registration Charges

Usage-based charges, carrier fees, telephone-number charges, campaign or brand registration fees, verification fees, pass-through charges, and similar third-party costs are nonrefundable once incurred, submitted, or committed, except for an incorrect or duplicate charge or as required by law.

5 Setup Fees Custom Work and Professional Services

Setup fees, implementation fees, consulting, design, development, custom configuration, and other professional-service fees are nonrefundable once work has begun or resources have been reserved. If an order or statement of work contains milestone, deposit, cancellation, or refund terms, those terms control for that work. If we cancel unperformed work without cause, we may refund prepaid fees allocable to the unperformed portion.

6 Duplicate Charges Billing Errors and Confirmed Technical Failures

We will correct confirmed duplicate charges or billing errors. We may also issue a refund, account credit, or other reasonable remedy when a confirmed failure within systems controlled by Branding Optics materially prevented use of a paid Service. Eligibility and the remedy will depend on the circumstances, affected period, available logs, third-party charges, and whether the customer promptly reported and reasonably assisted in troubleshooting the issue.

Carrier filtering, message delays or nondelivery, recipient-device issues, internet outages, third-party platform failures, incorrect customer configuration, insufficient consent, rejected registrations, and account suspension for policy or legal violations do not automatically qualify as a Branding Optics technical failure.

7 How to Request a Refund

Email legal@brandingoptics.com with the account name, account email, transaction date, amount, transaction or invoice number, and a brief explanation. Do not send full payment-card numbers. We may request additional information to verify the account and transaction.

Unless a longer period is required by law, refund or billing-error requests should be submitted within 30 days after the charge. Approval is not guaranteed. If approved, refunds are generally returned to the original payment method. Processing time depends on the payment provider and financial institution.

8 Chargebacks

Please contact us first so we can investigate. Initiating a chargeback does not cancel a subscription or resolve amounts properly owed. We may suspend an account while a payment dispute is pending and provide relevant account, consent, transaction, usage, and communication records to the payment processor as permitted by law.

9 Account Suspension or Termination

Refunds are not available when an account is suspended or terminated for fraud, abuse, unlawful messaging, lack of required consent, excessive complaints, nonpayment, chargebacks, carrier violations, or other material violation of our Terms, except where required by law. We may preserve records and unused balances while investigating suspected abuse.

10 Changes to This Policy

We may update this policy prospectively. The version in effect when a charge occurs will generally govern that charge, except where law requires otherwise.
